Terms of Service
These terms govern your use of the Vesper desktop app, the modules distributed for it, and the getvesperapp.com website, all provided by Vesper Technologies LLC.

1. Agreement
By downloading, installing or using Vesper you agree to these terms. If you do not agree to them, do not use Vesper. In these terms, “we”, “us” and “our” mean Vesper Technologies LLC, and “you” means the person or organization using the software. If you are agreeing on behalf of an organization, you confirm you have authority to bind it.
2. What the service is
Vesper is a desktop app for macOS and Windows. It installs and runs automation modules — separate, self-contained programs, each of which brings its own settings with it — at the times you choose, and keeps a record of what they produce on your own computer. We also supply the modules themselves and their updates.
Vesper does not decide what a module does or which websites it interacts with. It runs the modules you install, with the settings you give them, against the targets you point them at. What runs, when it runs and what it is aimed at are your decisions, and what a module produces is kept on your machine — see the Privacy Policy for the limited information the app does send us.
3. Your account
Access requires an account with our commerce provider, Whop, and an active subscription or other right of access granted by us. You must be at least 18 years old. You are responsible for keeping your account credentials secure and for everything done under your account. Tell us promptly at support@getvesperapp.com if you believe it has been compromised.
4. Licence
While your subscription is active and you are complying with these terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to install and use Vesper and the modules your subscription or other access covers, for your own personal or internal business purposes. The licence is for you to use the software; it does not transfer ownership of it.
You may not:
- Copy, sell, rent, sublicense, publish or otherwise distribute the software or any module.
- Reverse engineer, decompile or disassemble the software or any module, or attempt to derive its source code, except to the extent that applicable law expressly permits it despite this restriction.
- Circumvent, disable or interfere with the checks that confirm your right to use Vesper or that confirm the software and its modules have not been altered, with the delivery or installation of updates, or with the limits placed on a module — or run a module outside Vesper.
- Share your account or your access with anyone else.
- Remove or obscure any proprietary notice.
5. Acceptable use, and what is your responsibility
This is the section that matters most, so we will be direct about it.
You are responsible for what you automate, and for the consequences of automating it. Websites and online services set their own terms, and many of them restrict or prohibit automated access, automated account creation, or automated participation in promotions. Before you point a module at a service, it is your responsibility to know that service's terms and to comply with them, along with every law that applies where you are and where that service operates. Our providing a tool is not advice that any particular use of it is permitted.
You agree not to use Vesper to:
- Break any applicable law or regulation.
- Access any computer system, account or data you are not authorized to access, or defeat a security measure protecting one.
- Infringe anyone's intellectual property, privacy or other rights, or process another person's personal information without a lawful basis for doing so.
- Commit or facilitate fraud, or misrepresent your identity where identity matters.
- Disrupt or overload any service, network or infrastructure, whether by volume of requests or otherwise.
- Send unsolicited bulk messages.
You are also responsible for anything you feed into Vesper — email addresses, postal addresses, account details, proxies and other data — including having the right to use it for what you are using it for. If you are acting for an employer or a client, that responsibility sits with you as much as with them.
6. Modules
Modules interact with websites and services we do not control and which change without telling anyone. A module that works today may stop working tomorrow, and we do not warrant that any module will remain functional, available or effective. We may modify, replace, withdraw or stop supporting any module at any time. If one stops working, tell us at support@getvesperapp.com — we would rather know — but we cannot promise a fix, or a fix by any particular date.
Some modules require credentials or accounts with third-party services — captcha solvers, proxy providers, inbox or phone-verification services. Those relationships are between you and those providers, on their terms and at your cost. We are not responsible for what those providers charge you, for how they handle your data, or for what happens if they stop working.
7. Subscriptions, payment and refunds
Subscriptions are sold and billed through Whop, on the pricing and renewal terms shown to you at checkout, and are subject to Whop's own terms as well as these. Unless stated otherwise, subscriptions renew automatically until cancelled, and you can cancel at any time from your Whop account, with access continuing to the end of the paid period. Cancelling stops the next payment; it does not cut short the period you have already paid for.
Refunds follow the terms shown at checkout and are handled through Whop. If something has gone wrong on our side, write to us first — we would rather fix it.
8. Changes to the service
We are actively developing Vesper and may add, change or remove features, and may require you to install an update in order to keep using it. We will not deliberately remove a material feature you are paying for without telling you.
9. Suspension and termination
You may stop using Vesper at any time by cancelling your subscription and uninstalling it. We may suspend or terminate your access if you breach these terms, if your subscription lapses, if we are required to by law, or if we reasonably believe your use is causing harm — including interfering with the checks that confirm your right to use the software or that confirm it has not been altered. Where it is reasonable to do so, we will tell you first.
When your access ends, the licence in section 4 ends with it. Data already written to your own machine remains yours and stays where it is; ending your subscription does not reach back into your computer and take it away.
10. Your data
What your modules produce is written to a single file on your own computer, and it is yours. Our handling of the limited information the app does send us is described in the Privacy Policy, which forms part of these terms. Keeping your own backups is your responsibility; Vesper provides backup and restore for that purpose, and we recommend you use it before you move machines or reinstall.
11. Intellectual property
Vesper, the modules we distribute, this website and everything in them are owned by Vesper Technologies LLC or our licensors and are protected by intellectual property law. These terms grant you a licence to use the software, and nothing more. Feedback you send us we may use freely, without obligation to you.
12. Disclaimer of warranties
Vesper AND ALL MODULES ARE PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. We do not warrant that the software will be uninterrupted, error-free or secure, that any module will work against any particular website, or that using it will produce any particular result. Some jurisdictions do not allow the exclusion of implied warranties, in which case the exclusions above apply to the fullest extent permitted.
13. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, Vesper Technologies LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL OR OPPORTUNITY, ARISING OUT OF OR RELATING TO YOUR USE OF Vesper, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY.
OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO Vesper IN ANY 12-MONTH PERIOD WILL NOT EXCEED THE GREATER OF THE AMOUNTS YOU PAID US FOR Vesper IN THAT PERIOD, OR ONE HUNDRED US DOLLARS ($100).
Nothing in these terms excludes liability that cannot lawfully be excluded, including for fraud or for death or personal injury caused by negligence. Some jurisdictions do not allow certain limitations, in which case they apply to the fullest extent permitted.
14. Indemnity
You agree to indemnify and hold harmless Vesper Technologies LLC and its members, officers and employees from any claim, demand, loss or expense (including reasonable legal fees) arising out of your use of Vesper, your breach of these terms, your violation of any law, or your violation of the terms or rights of any third party — including the terms of any website or service you direct a module at.
15. Governing law and disputes
These terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules. You and we agree to the exclusive jurisdiction of the state and federal courts located in the State of New York for any dispute arising out of these terms, and each of us consents to venue there.
16. General
If any provision of these terms is held unenforceable, the rest remains in force. Our not enforcing a provision is not a waiver of it. You may not assign these terms without our consent; we may assign them in connection with a merger, acquisition or sale of assets. These terms, together with the Privacy Policy, are the entire agreement between us about Vesper.
17. Changes to these terms
We may update these terms. When we do we will change the date at the top of this page, and for a material change we will give notice in the app or by email. Continuing to use Vesper after a change means you accept the updated terms.
